Welcome to NIDSAN SHIPPING. By accessing our website, creating an account, or using our freight forwarding and logistics services, you agree to these Terms of Service. Please read them carefully.
1. Services
NIDSAN SHIPPING is a licensed Ocean Transportation Intermediary (OTI/NVOCC) and freight forwarder providing international ocean freight, trucking, warehousing, customs brokerage, and related logistics services. All services are subject to applicable U.S. federal and international laws and regulations.
2. User Accounts & Registration
To use our services, you must create an account and provide accurate, complete information including your legal business name, EIN/Tax ID, and valid identification. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access.
3. Booking & Shipping Terms
All bookings are subject to carrier availability, applicable tariffs, and trade compliance regulations. NIDSAN SHIPPING acts as a licensed freight forwarder and is not the actual ocean carrier. Rates quoted are valid for the specified period and subject to change based on carrier adjustments, fuel surcharges, or regulatory changes.
4. Required Documentation
When filing dock receipts and AES Direct, the U.S. Principal Person of Interest (USPPI) — the owner of the goods — must provide:
- Full legal name and mailing address
- Phone number
- Social Security Number or Tax ID (EIN) issued by the IRS
- Original vehicle title with owner's name, or title with bill of sale/reassignment

5. Customs Hold & Related Charges
In the event a container is placed on Customs hold, three types of charges may apply:
- Port charges: Imposed by port authorities for pulling the container from the vessel and transferring it to a warehouse for inspection
- Demurrage charges: Applied when the container remains beyond the allotted free time at the port
- Customs/warehouse charges: Fees for inspection services and warehouse handling
NIDSAN SHIPPING is not responsible for charges resulting from CBP container holds. The shipper/consignee is solely responsible for all costs related to customs clearance. We will make every effort to communicate with you throughout the process.
6. Rates & Payment
Payment terms are as specified on individual invoices. Late payments may incur additional charges as specified in your booking confirmation. We accept bank transfers (ACH/wire), credit cards, and Zelle payments.
7. Liability & Insurance
NIDSAN SHIPPING liability is limited as per the Carriage of Goods by Sea Act (COGSA) and applicable international conventions (Hague-Visby Rules). Maximum liability is limited to $500 per package or customary freight unit unless a higher value is declared and additional freight is paid. We strongly recommend obtaining adequate cargo insurance.
8. Prohibited & Restricted Items
Customers must comply with all U.S. export/import regulations including EAR, ITAR, and OFAC sanctions. The following require prior written approval: hazardous materials, controlled substances, weapons, sanctioned-country shipments, and dual-use items. Violations may result in account termination and reporting to authorities.
9. Hybrid & Electric Vehicles
Hybrid and electric vehicles are subject to additional shipping requirements and carrier surcharges due to lithium battery regulations. Failure to properly declare hybrid/electric vehicles may result in penalties and additional charges.
10. Cancellation Policy
Booking cancellations are subject to carrier cancellation fees and any costs already incurred. Contact us as soon as possible to minimize charges.
11. Governing Law
These terms are governed by the laws of the State of New Jersey and applicable federal maritime law. Any disputes shall be resolved in the courts of New Jersey.
